Abstract
קשה להפריז במשמעותן של שתי התקנות המיוחסות לרבנו גרשום מאור הגולה זו שאסרה על הגבר היהודי לקחת אישה שנייה וזו שאסרה עליו לגרש את אשתו בעל כורחה. האם אחת מן התקנות חמורה יותר מרעותה? לשאלה זו ישנה משמעות מעשית גם בימינו אנו במדינת ישראל. המאמר מוקדש לסוגיה זו: במקרה שאישה חויבה להתגרש בשל עילה כלשהיא, והיא מסרבת לקבל את גיטה - האם נעדיף לכפותה לקבל את הגט באמצעות הפעלת כוח או שמא נתיר לבעל לשאת אישה שניה?
