Abstract
רשימה זו סוקרת את ההתפתחויות במשפט הפלילי בשנת המשפט תש"ע תוך בחינת פועלו של המחוקק מול פועלם של בתי המשפט. הרשימה מצביעה על שתי מגמות כלליות בולטות המאפיינות את השנים האחרונות, ובכללן שנת תש"ע: האחת, הגברת התודעה והאכיפה במישור הפלילי המהותי מצד המחוקק; השנייה, הרחבת ההגנה החוקתית על זכויות הנאשם במסגרת ההליך הפלילי מצד בתי המשפט. הרשימה דנה בשאלה אם מגמות אלה סותרות או משלימות תוך בחינת המודלים המוצגים במאמרו הקלסי של הרברט פקר.
