Abstract
הערות והארות לתכלית האיזונים בין זרועות השלטון. בדור הבראשית של מערכת המשפט כיבוד עקרון הפרדת הרשויות נתפס כפשוטו - ואז נפרצו מיגבלות השיפוט מכל עבריה. אין מצב שבו שופט מתמנה חייב לגורם הממנה - והגורם הממנה ימנע קידום של שופט שאינו "צייתן" . נדרש מהלך מקדים של חקיקת יסוד, שתגדיר - חוק יסוד מהו?
