Abstract
A comparative study of two key Jewish law jurists from Eastern Europe who were active at the end of the nineteenth century and beginning of the twentieth century. The article probes different approaches to existing communal practices and customs that appear not to jibe with the law as recorded in earlier works. The study highlights the tension between the authority of law-on-the-books as opposed to law-in-action, a clash that comes to a head when a jurist undertakes the production of a new code of law.
