Abstract

Cross-examination is considered one of the most important and central litigation tools for uncovering truth. Despite the importance and vitality of the cross-examination,there may be situations in which witnesses or defendants who choose to testify are not cross-examined for various reasons. In some cases, they refuse to be cross-examined;other incidents follow intimidation or threats by the opposing party; and in certain cases this is due to higher-power intervention such as the death of the witness.This article discusses the legal status and evidentiary implications of avoiding cross-examination of witnesses and defendants in Israeli criminal proceeding. The article argues that despite the centrality of cross-examination in clarifying the truth,avoiding it does not necessarily harm this purpose. Furthermore, the article contends that avoiding cross-examination does not necessarily infringe on defendants' aggregate rights to fair trial. The conclusion of the article is that the implications of cross-examination avoidance should remain within the court discretion, depending on the specific case and its circumstances.
