Abstract
This paper is a chapter in a monograph dealing with gender equality between mothers and fathers with regard to the maintenance of children.The article concerns a ruling by the Israeli Supreme Court that attempted to resolve a sensitive problem in Israeli society regarding gender equality vs.affirmative action and progress in family relations vs. rabbinic tradition.The ruling establishes a model of equality between fathers and mothers relying on two components. One is the adaption of the opinion of some halakhic authorities that the obligation of maintaining children older than six years of age can be equally shared by the parents. The second is the suggestion of a new model according to which parents share an equal obligation, so that neither of them loses their right to self-fulfillment in the future.
