בשנות העשרים והשלושים של המאה העשרים התנהלה מחלוקת עקרונית על אודות הדרך הראויה לחקר המשפט העברי. המאמר סוקר את הדעות שהושמעו בוויכוח ואת המניעים שעמדו מאחורי דעות אלה.
